Terms of Service

1. Service Description

Salvio provides a REST API that returns structured product data, brand-to-generic equivalence mappings, ingredient analysis, and safety information for U.S. over-the-counter (OTC) medications. Data is sourced from publicly available FDA databases (the OpenFDA NDC Directory and OpenFDA Drug Label API) and is normalized, enriched, and made available programmatically.

The Service is informational only. Salvio does not provide medical advice, clinical decision support, diagnosis, or treatment recommendations. All product data, safety notes, ingredient analysis, and equivalence mappings are provided for informational and educational purposes. They are not a substitute for professional medical judgment.

2. Accounts and API Keys

To use the Service, you must create an account and obtain an API key. You are responsible for maintaining the security of your API keys and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

API keys are confidential. Do not share, publish, or embed API keys in client-side code, public repositories, or any context where they may be exposed to unauthorized parties. Salvio reserves the right to revoke keys that are compromised or misused.

3. Acceptable Use

You may use the Service for lawful purposes that are consistent with these Terms. You agree not to:

• Use the Service to provide medical diagnoses, prescribe medications, or offer clinical treatment recommendations to end users without the involvement of a licensed healthcare professional.
• Present Salvio data as medical advice, clinical guidance, or a substitute for consultation with a pharmacist, physician, or other licensed provider.
• Resell, redistribute, or sublicense raw Salvio API responses as a standalone data product without adding substantial independent value.
• Use the Service in any way that violates applicable laws, regulations, or third-party rights.
• Attempt to circumvent rate limits, authentication, or other technical controls.
• Use the Service to build a product that competes directly with the Salvio API (i.e., repackaging our data as an API).

4. Required Disclaimers for Your Applications

If you use Salvio data in a consumer-facing application, you must include a prominent disclaimer that communicates, in substance:

The exact wording may be adapted to fit your application's context, but the substance must convey that the information is informational only, not medical advice, and that users should consult a healthcare professional.

5. Data Sources and Accuracy

Salvio data is derived from publicly available U.S. government sources, primarily the FDA's NDC Directory and the OpenFDA Drug Label API. We normalize and structure this data for developer consumption. Ingredient identifiers are cross-referenced against NLM's RxNorm vocabulary.

While we make reasonable efforts to ensure data accuracy and freshness, Salvio does not guarantee that data is complete, current, or error-free. Government source data may lag behind real-world product changes. Equivalence mappings are based on active ingredient matching and do not account for all factors that may affect therapeutic equivalence (e.g., bioavailability, inactive ingredient sensitivities, or formulation differences).

You are responsible for validating Salvio data against your own quality requirements before relying on it in production. We recommend cross-referencing critical data points with primary sources.

6. Pricing and Payment

The Service is offered in tiered plans as published on our website. Free-tier usage is subject to rate limits. Paid plans are billed monthly. Overage charges, if applicable, are calculated at the per-call rates specified in your plan.

We reserve the right to modify pricing with 30 days' written notice. Price changes do not apply retroactively to the current billing period.

7. Rate Limits

Each plan includes a monthly request allocation. When you exceed your allocation, the API will return HTTP 429 (Too Many Requests) with rate limit headers indicating your usage and reset date. Paid plans may include per-call overage billing instead of hard limits.

Repeated or intentional abuse of rate limits may result in temporary suspension or permanent revocation of your API key.

8. Uptime and Service Levels

We target high availability but do not guarantee uninterrupted access. Scheduled maintenance windows will be announced in advance. Enterprise plans may include formal SLA commitments with defined uptime percentages and remedies.

The Service depends on upstream data sources (OpenFDA, RxNorm) that are operated by third parties. Salvio is not responsible for downtime or data quality issues originating from these upstream sources.

9. Intellectual Property

Salvio's API design, documentation, normalization logic, equivalence algorithms, and proprietary data enrichments are the intellectual property of Salvio Health The underlying FDA data is in the public domain.

You retain ownership of the applications you build using the Service. We grant you a non-exclusive, non-transferable license to use the Service in accordance with these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Salvio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages resulting from reliance on data provided by the Service for medical, clinical, or health-related decisions.

Salvio's total liability for any claim arising under these Terms shall not exceed the amount you paid to Salvio in the twelve (12) months preceding the claim.

This limitation applies regardless of the legal theory (contract, tort, strict liability, or otherwise) and even if Salvio has been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Salvio, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your end users' reliance on data provided through your application; or (d) any claim that your application provides medical advice using Salvio data without appropriate professional oversight and disclaimers.

12. Termination

Either party may terminate this agreement at any time. You may stop using the Service and delete your API keys. We may suspend or terminate your access if you violate these Terms, with reasonable notice when practicable.

Upon termination, your API keys will be deactivated and your access to the dashboard will be revoked. We may retain usage logs for billing and compliance purposes for up to 12 months after termination.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to the address associated with your account at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
